Whilst we endeavour to provide the best possible professional service to every applicant, Maldives Employment Services cannot accept any financial responsibility or liability in any capacity to any of our candidates under any circumstances.

This includes: financial loss including loss of earnings and future earnings suffered by the candidate; loss of employment or advancement by the candidate in current role; disclosure of the candidate’s intent to leave current employer; withdrawal of an offer of employment to the candidate by a prospective future employer; and failure of the candidate to obtain a work permit from the Department of Immigration & Emigration, or avail all required laws of candidate’s resident country or that the foreign country.

By applying through our website for representation by Maldives Employment Services, candidates are deemed to accept and agree to these terms unconditionally.

Whilst we always endeavour to assist candidates on a 100% free-of-charge basis, we reserve the right to invoice with a contigent charge (of US$1000) for recruitment services rendered where a job-seeker has been offered and accepted a position found by ourselves on their behalf but subsequently fails either a) to commence employment as they have contractually agreed,  or b) to complete their contract properly. This contingent charge is made because both situations expose Maldives Employment Services to the risk of reputational damage and/or finding a replacement candidate for the employer. Failure to settle this account within a month of invoicing will lead us to report the candidate to their professional organisation, employer or other body, or to take alternate action, until proper settlement is made. Note that Maldives Employment Services reserves the sole right to waive this contingent charge, depending on the specific prevailing circumstances.






The following Terms & Conditions of business are between Maldives Employment Services (hereinafter "HR") and the Employer Client (hereinafter the "Client") and shall be deemed to have been accepted in their entirety if the Client avail a recruitment service of HR or interviews or agrees to employ any person (hereinafter "Candidate") provided,  procured or introduced via HR within a period of 12 months of introduction.  


General terms


1.  The Client agrees to notify HR immediately a Candidate agrees to join the Client as an employee,  in whatever capacity.  The Client herein becomes liable to pay and shall pay a fee to HR for the introduction following the successful Candidate's engagement as laid out according to the Fee Calculation section.


2.  Invoices or fees must be settled within thirty days of the date of the invoice in accordance with the payment instructions detailed on the invoice.


3.  The Client and HR will both respect the confidentiality of all information exchanged between them.


4.  Given the confidential nature of introductions,  should the Client (or a member of the Client's staff or the Client's agent) within a twelve month period from the date of the relevant introduction pass to a third party details of a Candidate originally introduced by HR and that Candidate is subsequently engaged for employment then such engagement will render Client liable for the fee/s of HR , even though the introduction may be made indirectly.


5.  The fees applied or charged will additionally include any form of tax wherever applicable and invoiced to the Client accordingly.


6.  The contract shall be governed by and construed in accordance with and take effect exclusively under the laws of the Republic of Maldives.


Disclaimer of liability


7.  HR shall not be liable under any circumstances for any loss damage or expense suffered or incurred by the Client arising from,  or in any way connected with,  HR seeking a Candidate for the Client or the introduction by HR to the Client of any Candidate.


8.  Although HR makes every effort to select and introduce only suitable Candidates for interview with the Client,  the Client shall notwithstanding satisfy themselves as to the suitability of any Candidate and shall take up any references provided before engaging any Candidate in employment.  HR can accept no liability for the integrity of professional qualification capabilities or medical history in respect of any Candidate introduced nor are references sought unless specifically requested in writing.


9.  The Client shall be responsible for obtaining work and other permits,  medical examinations and/or investigations into the medical history of any Candidate,  and satisfy any medical and other requirements or qualifications required by law and/or the immigration authorities, or as per the terms and consitions thereto of an agreed written covenant by HR and the Client.


Variation of terms


10.  These Terms & Conditions may be varied at any time by HR. No other variation of any kind is valid unless explicitly agreed by HR in writing.


Legal jurisdiction


The provisions set forth herein does not supersede all other written or oral communications or agreements with regard to the subject matter hereof. If any of these provisions is found to be unenforceable or invalid, the remaining provisions hereof shall be enforceable and valid to the greatest extent permitted by law. These provisions shall be governed by and interpreted in accordance with the laws of the Republic of Maldives.
